Insurance companies challenge BPJS Law

Four insurance companies have petitioned the Constitutional Court for a judicial review of articles in the Social Security Providers (BPJS) Law that oblige employees to register for health insurance with the Healthcare and Social Security Agency (BPJS Kesehatan).

The petitioners — PT Papan Nirwana, PT Cahaya Medika Health Care, PT Ramamuza Bakti Usaha, PT Abdiwaluyo Mitrasejahtera — argue that the articles have created monopolies in the health insurance industry.

“When employers and workers are obliged to register with the BPJS, then commercial insurance cannot attract more people,” said the petitioners’ lawyer, Aan Eko Widiarto, as quoted by detik.com during a hearing at the court on Tuesday.

The panel of justices, led by Muhammad Alim, said the court would hear expert testimony before deciding on the case
